International Covenant on Civil and Political Rights (ICCPR) – Article 9: Liberty and Security of Person

The International Covenant on Civil and Political Rights (ICCPR) – Article 9 guarantees the right to liberty and security of person, prohibiting arbitrary arrest or detention. It ensures that any deprivation of liberty must be lawful, reasonable, and subject to prompt judicial review.

  • Article 9(1) – Everyone has the right to liberty and security of person. No one shall be subjected to arbitrary arrest or detention.
  • Article 9(3) – Anyone arrested or detained must be brought promptly before a judge and tried within a reasonable time or released.
  • Article 9(4) – Everyone has the right to challenge the lawfulness of their detention before a court.

🚫 Violation:Arbitrary arrest, incommunicado detention, denial of legal access, and holding individuals without charge or in secret locations all amount to violations of personal liberty and are considered forms of institutional violence under international law.

These violations reflect a systematic abuse of due process and disregard for the fundamental protections enshrined in international law.
