International Convention for the Protection of All Persons from Enforced Disappearance

Kenya has signed but not ratified this convention (as of 2024).

The ICPPED defines enforced disappearance as:

"The arrest, detention, abduction or any other form of deprivation of liberty by agents of the State... followed by a refusal to acknowledge the deprivation of liberty or by concealment of the fate or whereabouts of the disappeared person..."

Obligations under the ICPPED (if ratified)

  • Criminalize enforced disappearance as a separate offense.
  • Investigate and prosecute perpetrators.
  • Ensure victims’ right to truth, justice, and reparation.
  • Prevent secret detentions and maintain accurate registers of all detainees.

Status: Signed by Kenya on 8 February 2007 but not yet ratified.
